Yesterday, the U.S. Environmental Protection Agency released a proposed rule that would provide a narrow interpretation of the “waters of the United States” (WOTUS) definition under the Clean Water Act. This definition is the basis for federal oversight of those waters that fall under this definition. The proposal is a reaction to the U.S. Supreme Court’s decision in Sacket that narrowed federal oversight of waterways.
