HOUSE PASSES OPPORTUNITY ZONE BILL
The state House recently passed a bill designed to promote more
redevelopment of former industrial land in Pennsylvania communities. The
bill, HB 2297, is one component of Gov. Ed Rendell's economic stimulus
package. It would extend and expand the Keystone Opportunity Zone program,
which allows tax abatements for redevelopment of specifically designated
idle or abandoned properties. The bill also extends the abatement period
for another seven years to stimulate development in existing KOZ districts.

BINGO BILL APPROVED BY HOUSE
The state House has passed a bill authored by state Rep. Don Walko,
(D-Allegheny), that would update Pennsylvania's limits on how much nonprofit
organizations can earn from bingo games. Rep Walko's bill, HB 2204, would
make several changes to reflect current technology and monetary inflation:
• increase the maximum payout per day from $4,000 to $10,000;
• allow organizations to have bingo up to four days a week, up
from the current limit of two;
• allow an organization to offer one progressive jackpot per day
that could increase by $10,000 per day, up to a limit of $50,000;
• allow the use of handheld electronic bingo cards;
• allow leasing of bingo halls and compensation for
professionals to run the games; and
• remove limits on advertising.
The bill now goes to the Senate for consideration.

OFFICIALS DISCUSS CHANGES TO OPEN RECORDS LAW
According to a recent Pittsburgh Tribune-Review news article, the new state
Right to Know Law, which goes into effect Jan. 1st, is putting the burden
on political subdivisions to prove why a record may not be made available,
spurring public officials to learn more about regulations going into effect
next year. One of the most significant changes to the 50-year-old
open-records law is the presumption that a record is public unless a
political subdivision proves it isn't because of any of 30 exceptions
covering matters like a person's medical or Social Security information,
negotiations or security. However, in many instances, the public entity
should hand over the data after the private information is redacted. The
existing law requires the person requesting the information to prove that
the record is public.

SENATE APPROVES BILL CREATING A STATEWIDE MUTUAL AID AGREEMENT SYSTEM
The state Senate recently approved SB 1225, sponsored by Senator John Pippy
(R-Allegheny), to assist counties and municipalities in responding to
disasters. According to press reports, Mutual Aid Agreements are used to
respond to manmade and natural disasters that require actions beyond the
capacity of the municipality or county in which the incident has occurred.
The bill establishes a statewide Mutual Aid Committee to oversee the
implementation of a statewide mutual aid system. The legislation was
drafted in conjunction with the Governor's Office, PEMA and the University
of Pittsburgh Institute of Politics and now goes before the House for
consideration.

MEETINGS HELD ON BUILDING CODE REFORM
The Senate Labor and Industry Committee has approved legislation, HB 1096,
that will establish a technical review and advisory council to address
updates to the Pennsylvania Uniform Construction Code. Hearings have been
held with the Labor and Industry Committee and the Senate Local Government
Committee to hear from local government officials, code enforcement
officials, affected industry representatives and citizens to determine how
implementation of the building code can be improved.
The Labor and Industry Committee has also recently approved SR 263, that
directs the Legislative Budget and Finance Committee to conduct a study
relating to the $4.00 fee imposed on each construction and building permit
issued under the Construction Code Act. The fees were established to fund
education and training programs for municipal code officials and agencies
that enforce the Code. The report will determine the effectiveness of the
programs. The Legislative Budget and Finance Committee will report its
findings to the General Assembly by the end of September.

HOUSE BILL WOULD PREVENT PRIVATE CITIZEN POLICE FORCES
State Rep. Vince Biancucci, (D-Beaver), has introduced a bill in the House of
Representatives that would prevent ordinary citizens from creating private
police forces. The bill, HB 2382, would repeal an obsolete provision under
Title 22 of the Pennsylvania Consolidated Statutes that allows ordinary
citizens to form private police forces. A group of residents in Lawrence
County formed a private police force and requested that it also be
recognized in Beaver County. The Beaver County district attorney denied the
group's request and the private police force subsequently started
disbanding. Biancucci hopes to repeal the provision and prevent any further
occurrences.

STATE SENATOR CALLS FOR STUDY OF UCC PERMIT FEE
State Senator Mike Waugh (R-York) has introduced SR 263, which calls for the
Legislative Budget and Finance Committee to conduct a study of the $4.00
construction and building permit fee levied under the Uniform Construction
Code (UCC). Specifically, the resolution directs the Legislative Budget and
Finance Committee to conduct a study of how much money has been raised by
the $4.00 fee, how much is deposited in the two training accounts, and how
the money in these accounts is actually being spent. The results are to be
reported to the General Assembly by June 2008. The revenues from the fee are
deposited into two accounts – the Municipal Code Official Training Account
and the Construction Contractor Training Account, which were established to
provide training programs for municipal officials and contractors.
